Terms and Conditions
Please read these Terms and Conditions ("Terms") carefully before using the Mountain Labs LLC. website (www.mountainlabs.io) or purchasing any product or service from us. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. About Us
Mountain Labs Inc. is a corporation incorporated in the State of Wyoming, USA ("Mountain Labs", "we", "us", "our"). We design and manufacture indoor air quality monitoring hardware and software, including the Odak IAQ Monitor.

2. Acceptance of Terms
By using our website, creating an account, or placing an order, you confirm that:
You are at least 18 years old (or the age of majority in your jurisdiction).
You have the legal capacity to enter into a binding contract.
You have read and agree to these Terms and our Privacy Policy.
If purchasing on behalf of a business, you have authority to bind that business.
3. Products
3.1 Product Descriptions
We make every effort to display product descriptions, images, and specifications accurately. However, colors may vary due to monitor settings, and specifications may be updated without prior notice. We reserve the right to discontinue any product at any time.
3.2 Pricing
All prices are displayed in the currency of your selected region. We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you place your order. Prices do not include taxes, customs duties, or import fees unless explicitly stated.
3.3 Availability
We cannot guarantee that any product will be available at any given time. If a product you ordered is out of stock after payment, we will notify you and offer a full refund or the option to wait for the item to be restocked.
4. Orders and Contract Formation
An order placed on our website constitutes an offer to purchase. The contract between you and Mountain Labs LLC. is formed when we send you an order confirmation email. We reserve the right to reject or cancel any order at our discretion (for example, due to pricing errors, suspected fraud, or inability to fulfill). If we cancel your order after payment, you will receive a full refund.
5. Payment
We accept major credit and debit cards, and other payment methods as displayed at checkout.
All payments are processed securely through Stripe Inc. Mountain Labs does not store your payment card information.
By providing payment details, you authorize us to charge the full amount for your order.
In the event of a failed payment, we reserve the right to cancel your order.
6. Shipping and Delivery
6.1 Shipping Regions
We ship to the United States, the European Union, the United Kingdom, and Türkiye. For EU shipments, we ship on a DDP (Delivered Duty Paid) basis, meaning customs duties and import VAT are included in the price. For other international destinations, please contact us.
6.2 Delivery Times
Estimated delivery times are provided at checkout. These are estimates only and not guaranteed. Mountain Labs is not responsible for delays caused by shipping carriers, customs clearance, or force majeure events.
6.3 Risk and Title
Risk of loss and title to products pass to you upon delivery to the shipping carrier. If your package is lost in transit, please contact us at support@mountainlabs.io and we will work with the carrier to resolve the issue.
7. Consumer Rights — EU and UK Customers
If you are a consumer resident in the European Union or United Kingdom, you have the following statutory rights in addition to any rights under these Terms:
Right of withdrawal: You have the right to cancel your order within 14 days of receiving the product without giving any reason (the "cooling-off period"), in accordance with EU Directive 2011/83/EU. To exercise this right, notify us at returns@mountainlabs.io before the 14-day period expires.
Return shipping: You are responsible for the cost of returning the product during the 14-day cooling-off period, unless the product is defective.
Refund timeline: We will reimburse all payments received, including standard delivery costs, within 14 days of receiving the returned product or proof of return.
Statutory conformity guarantee: You are entitled to a legal conformity guarantee of 2 years from delivery, per EU Directive 2019/771. Defective products within this period will be repaired, replaced, or refunded at our cost.
8. Consumer Rights — Turkish Customers
Turkish consumers are protected by the Turkish Consumer Protection Law (Tüketicinin Korunması Hakkında Kanun No. 6502) and related regulations:
You have the right to withdraw from a distance contract within 14 days of delivery without providing any reason or paying any penalty.
We will refund all payments within 14 days of receiving your withdrawal notice and the returned product.
The seller warranty (satıcı garantisi) is 2 years for manufacturing defects. For branded products, the manufacturer's warranty is also applicable.

9. Returns and Refund Policy
Our Return and Refund Policy is set out in a separate document available on our website. For consumers, nothing in our return policy limits your statutory rights.
10. Limited Warranty
10.1 Warranty Coverage
Mountain Labs Inc. warrants that the Odak IAQ Monitor will be free from defects in materials and workmanship for a period of two (2) years from the date of original purchase ("Warranty Period").
10.2 Warranty Exclusions
This warranty does not cover:
Damage caused by accident, misuse, negligence, or unauthorized modification.
Normal wear and tear, including sensor degradation over time beyond specified tolerances.
Damage resulting from failure to follow product instructions.
Cosmetic damage such as scratches to the wood enclosure.
Products purchased from unauthorized resellers.
10.3 Warranty Claims
To make a warranty claim, contact support@mountainlabs.io with proof of purchase and a description of the defect. We will, at our sole discretion, repair, replace, or refund the product.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Mountain Labs' total liability to you for any claim arising from these Terms or the use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.
Mountain Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.
Mountain Labs is not liable for health decisions made based on data from the Odak device. The Odak Monitor is a consumer electronics device and does not constitute medical advice or a medical device. Always consult qualified professionals for health concerns.
Some jurisdictions do not allow limitation of liability, so the above limitations may not apply to you in full.
12. Intellectual Property
All content on our website, including text, graphics, logos, images, firmware, and software, is the property of Mountain Labs LLC. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent. The name "Mountain Labs", "Odak", and associated logos are trademarks of Mountain Labs Inc.
13. User-Generated Content
If you post reviews, comments, or other content on our website or social media channels, you grant Mountain Labs a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for marketing and business purposes. You confirm that such content does not infringe third-party rights.
14. Prohibited Use
You agree not to:
Use our website for any unlawful purpose.
Reverse-engineer, decompile, or disassemble our firmware or software beyond what is expressly permitted by law.
Attempt to gain unauthorized access to our systems.
Use automated bots to scrape or interact with our website.
Post false, defamatory, or misleading reviews or content.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles.
15.2 EU and UK Consumers
If you are a consumer resident in the EU or UK, you also have the benefit of the mandatory consumer protection laws of your country of residence, which may give you additional rights. Nothing in these Terms affects your right to rely on such laws. EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
15.3 Turkish Consumers
Turkish consumers may refer disputes to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or Consumer Court (Tüketici Mahkemesi) in their place of residence.
15.4 General Dispute Resolution
We encourage you to contact us first to resolve any dispute informally at legal@mountainlabs.io. If informal resolution is not possible, disputes shall be resolved by binding arbitration in Sheridan, Wyoming, under the rules of the American Arbitration Association (AAA), except where prohibited by local law.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated effective date. Your continued use of our website or services after the effective date of changes constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Return & Refund Policy, constitute the entire agreement between you and Mountain Labs LLC. regarding your use of our services.
